These Terms & Conditions (“Terms”) govern your use of BahiQo, a digital bahi khata / credit ledger Service for businesses (mobile apps, API, and related websites). By registering or using BahiQo, you agree to these Terms and our Privacy Policy.
1. Eligibility
- You must be able to form a binding contract under applicable law (generally 18+).
- You must use BahiQo for legitimate business bookkeeping purposes.
- You are responsible for ensuring your use complies with local laws and tax obligations.
2. Account registration & security
- Accounts are created/logged in primarily via mobile number + OTP.
- You must provide accurate information and keep your number accessible to receive OTPs.
- You are responsible for activity under your account and devices where you remain logged in.
- Do not share OTPs, API tokens, or account access with unauthorised persons.
- Notify us promptly if you suspect unauthorised access. You may delete your account in-app.
- We may limit concurrent devices according to admin/device policies.
3. The Service
Subject to these Terms and your plan limits, BahiQo may provide:
- Business profiles and member access (as implemented).
- Customer and supplier ledgers with credit/payment entries, balances, due dates, and statements.
- Reminders/notifications, reports, media uploads (photos/invoices), and related features.
- Admin-managed configuration for API access and storage.
Features may change, be added, or discontinued as we improve the product. We will try to avoid unreasonable disruption to core ledger access.
4. Your content & responsibilities
- You retain ownership of the business/ledger data and media you enter (“Your Content”).
- You grant us a limited licence to host, process, backup, and display Your Content solely to operate the Service.
- You are solely responsible for the accuracy of amounts, parties, invoices, and reminders you create.
- You must not upload unlawful, infringing, malware-containing, or abusive content.
- Customer/supplier personal data you store is entered by you as a business user; you are responsible for having a lawful basis to process that data.
5. Acceptable use
You agree not to:
- Attempt to access another user’s business or ledger without authorisation.
- Reverse engineer, overload, scrape, or disrupt the API/admin systems except as allowed by law.
- Bypass authentication, rate limits, or security controls (including shared API tokens meant for official apps).
- Use BahiQo for fraud, money laundering, harassment, or other illegal activity.
- Misrepresent your identity or business.
We may suspend or terminate accounts that violate these Terms or create security risk.
6. Subscriptions, fees & taxes
- Some features may require a paid plan. Pricing and limits will be shown in-app or on our site.
- Payments may be processed by third-party gateways; their terms also apply.
- Fees are generally non-refundable except where required by law or expressly stated.
- You are responsible for applicable taxes on your subscription and on your own business transactions recorded in BahiQo.
7. Intellectual property
- BahiQo name, logos, software, UI, and documentation are our intellectual property (or licensors’).
- You may not copy, resell, or white-label the Service without written permission.
- Feedback you provide may be used to improve BahiQo without obligation to you.
8. Privacy & data security
Our handling of personal data is described in the Privacy Policy. You acknowledge that:
- Ledger and party data you store can be sensitive business information — protect device access.
- We use HTTPS, token-based API auth, business scoping, encrypted secrets, and secured media storage as described in the Privacy Policy.
- You should export/backup critical records as needed for your own compliance.
9. Disclaimers
- THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
- We do not warrant uninterrupted or error-free operation, or that balances will match external systems if you enter incorrect data.
- BahiQo does not provide legal, tax, accounting, or investment advice.
- OTP SMS delivery depends on telecom/SMS providers and may occasionally be delayed.
10. Limitation of liability
To the maximum extent permitted by applicable law, BahiQo and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, business interruption, or ledger discrepancies arising from your use of the Service or third-party outages (hosting, SMS, storage, notifications, payment gateways).
Our aggregate liability for claims relating to the Service in any 12-month period shall not exceed the fees you paid us for the Service in that period (or INR 1,000 if you are on a free plan), except where liability cannot be limited under Indian law.
11. Indemnity
You agree to indemnify and hold harmless BahiQo from claims arising out of Your Content, your misuse of the Service, your violation of these Terms, or your violation of others’ rights (including privacy rights of customers/suppliers you record).
12. Suspension & termination
- You may stop using BahiQo and delete your account at any time via in-app deletion (where available).
- We may suspend or terminate access for Terms violations, non-payment, legal risk, or prolonged inactivity.
- On termination, your right to use the Service ends; provisions that should survive (IP, liability limits, indemnity) survive.
13. Changes to the Service or Terms
We may update these Terms. The “Last updated” date will change. Continued use after changes constitutes acceptance. If you do not agree, stop using the Service and delete your account.
14. Governing law & disputes
These Terms are governed by the laws of India. Courts at a competent jurisdiction in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
